1.1 The Where2Stay-SouthAfrica website is owned and operated by PanzaFusion Accommodation CC. All databases, information and systems are the property of PanzaFusion. Every effort is made to ensure that the information contained within the Where2Stay-SouthAfrica.com site is accurate and up to date. However, we cannot be held responsible for the accuracy of information supplied by the individual advertisers/establishments. All material supplied by our advertisers/establishments is used by Where2Stay-SouthAfrica.com on the basis that they own the rights to the said material. All material is accepted and used on an 'as is' basis and is not supplied to meet the needs of the user's individual requirements. Where2Stay-SouthAfrica.com disclaims all liability for any loss, damage, injury or expense however caused, arising from the use of or reliance upon, in any manner, the information provided through this service and does not warrant the truth, accuracy or completeness of the information provided by its advertisers.
1.2 This web site is supplied on an 'as is' basis and has not been compiled or supplied to meet the user's individual requirements. It is the sole responsibility of the user to satisfy himself or herself prior to entering into this agreement with Where2Stay-SouthAfrica that the service available from and through this web site will meet the user's individual requirements and be compatible with the user's hardware and/or software.
1.3 The establishment owner and/or operator agrees that guest comments can be published on the establishment listing by guests who have stayed at the establishment and further agrees that Where2Stay-SouthAfrica is not liable or responsible in any way for the verification or accuracy of any guest comments made.
1.4 Where2Stay-SouthAfrica makes no representation regarding any other web sites that may be accessed through this service and accordingly accepts no responsibility for the content or use of such web sites or information contained therein. In addition, it shall not be liable to any party for any form of loss or damage, consequential or otherwise, incurred as a result of any use or reliance on any information contained on such a web site or any web sites which can be accessed through this web site.

2.1 Establishment Owner Subscription
2.1.1 The Where2Stay-SouthAfrica website uses a secure operating system and interfaces with a transaction portal operated by 2Checkout. All credit card payment processing will be done through 2Checkout's secure payment gateway. Credit Card details are not stored on the Where2Stay-SouthAfrica website.
2.2 Room Rates
2.2.1 All rates published on the site are subject to change without notice. We strongly suggest that you reconfirm rates and service expectations when making a booking. All information supplied on the Where2Stay-SouthAfrica.com is a guide only and is subject to change without notice.
2.2.2. Where2Stay-SouthAfrica is not liable for incorrect rates specified on the web site and will not be obliged to supply bookings at those rates. The quotation supplied by the establishment is the responsibility of the establishment.
2.3 Payment Options Accepted
2.3.1 Payment for booking accommodation may be made via Visa or Mastercard credit cards or by bank transfer into the Where2Stay-SouthAfrica.com bank account, the details of which will be provided on request.
2.4 Credit Card acquiring and Security
2.4.1 Credit Card transactions for the purposes of booking accommodation will be acquired for Where2Stay-SouthAfrica.com via PayGate (Pty) Ltd who are an approved payment gateway for ABSA/FNB/Nedbank/SBSA South Africa. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
2.4.2 Customer details will be stored by Where2Stay-SouthAfrica.com separately from card details which are entered by the client on PayGate's secure site.
2.5 Merchant Outlet Country and Transaction Currency
2.5.1 The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).
3.1 Establishments may apply cancellation policies and it is the sole responsibility of the establishment owner to notify these clearly on every quotation.
3.2 Bookings through this website are subject to any Cancellation policy that may be stipulated by the establishment. Where a direct booking is made via the Where2Stay-SouthAfrica website booking enquiry system guests should ensure they are familiar with the establishments cancellation policy prior to making payment.
3.3 If a guest cancels a booking they may be liable for cancellation and/or admin fees as stipulated on the establishments quotation. By accepting the establishment’s quotation the guest accepts the cancellation terms on that quote.
3.4 To prevent fraud, some establishments may request that refunds for amounts originally paid via Where2Stay-SouthAfrica.com by credit card be refunded by Where2Stay-SouthAfrica.com so that the refund can be made to the credit card that was used for the original payment. In this case Where2Stay-SouthAfrica.com reserves the right to make the refund to the guest only after it has received the refund from the establishment.
3.5 Where2Stay-SouthAfrica do not get involved with disputes between establishments and clients with regard to Cancellations. Any dispute between a client and an Establishment over a cancellation is solely between the two parties concerned.
4.1 PanzaFusion Accommodation CC respects the privacy of our establishment owners and therefore all personal information provided to us with the utmost confidence and will under no circumstances be shared or passed on to any third parties.
4.2 All communications are conducted directly between the user and the accommodation establishments featured on the Where2Stay-SouthAfrica.com website. The information you provide when completing enquiry or booking forms will not be used for any other purposes other than to fill orders or respond to your enquiries.
4.3 Where2Stay-SouthAfrica.com shall take all reasonable steps to protect the personal infomration of users. For the purposes of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: PAIA Act 2
5.1 Any person that delivers or attempts to deliver any damaging code to this web site or attempts to gain unauthorised access to any page on this web site shall be prosecuted and civil damages shall be claimed in the event that Where2Stay-SouthAfrica suffers any damage or loss.
6. GENERAL INFORMATION
6.1 Users may contact Where2Stay-SouthAfrica by sending an e-mail to info@Where2Stay-SouthAfrica.com by using the 'contact us' button on the website.
6.2 Where2Stay-SouthAfrica is also responsible for providing support to users of the website by means of the 'contact us' button.
6.3 Where2Stay-SouthAfrica does not, however, underwrite or guarantee bookings between guest and establishment.
7. Venue Owner Refund Policy
7.1 If you are not 100% satisified with your purchase, within 60 days from the purchase date, we will refund the cost of your order
8.1 Where2Stay-SouthAfrica.com may, in its sole discretion, change this agreement or any part thereof at any time without notice.
9. Country of domicile
9.1 This website is governed by the laws of South Africa and Starchild Global chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
